Unanswered: issue with OrderBy property and date format

I have a subform where if I right click and reorder by the column it reorders it correctly. Now on this subform I have a checkbox that requeries the form but it won't keep the ordering that I had. the property is set correctly but the form won't order that way. Now if I click on this button that is on the main form, it requeries the subform in the correct order. Why does it work only when I hit this button on the main form? any ideas?

Also, does anyone know how to overide the default windows date format. right now it is mm/dd/yyyy and I want it to be mm/dd/yy when I have text boxes as date format.
